IMPERFECT RECOLLECTIONS - The Indian Supreme Court on Trade Mark Law
Author: Eashan Ghosh
Year: 2024
Since 1951, the Supreme Court has, in over one hundred and fifty key decisions, visited some of the most heavily litigated issues in trademark law. These decisions cover subjects such as the similarity inquiry, jurisdiction, limitations on and cancellations of trademark registrations, descriptiveness, prior use, honest concurrent use, delay and acquiescence, criminal actions, and injunctions. Across thirteen essays, Imperfect Recollections chronicles these contributions by the Supreme Court and locates them within the broader meta of Indian trademark law. These Supreme Court decisions are framed in context by statutory provisions, legislative history, common law principles, rules of practice, and modern trends, and backed up by references to over 3,500 cases from India and around the common law world
Revised and updated up to 2024, the second edition of Imperfect Recollections offers a nuanced and comprehensive text on Indian trademark law – one that appeals to beginners and experts alike.
